C4 Center continues to reiterate calls for a reform in Malaysia’s whistleblower protection framework

PETALING JAYA: The Center to Combat Corruption and Cronyism (C4 Center) has reiterated its calls for a reform in Malaysia’s whistleblower protection framework, calling the Chief Commissioner of Malaysian Anti-Corruption Commision’s recent exposure of the Sabah whistleblower’s name as reckless. In a statement March 13, it said the exposure of the whistleblower’s personal information further illustrated the deficiencies in Malaysia’s whistleblower protection framework which – in light of the inadequacy of amendments to the Whistleblower Protection Act (WPA) 2010 tabled recently – highlight the pressing need for an overhaul of the system.

“Former MACC Chief Commissioner Latheefa Koya announced during a press conference on March 11th that Lawyers for Liberty would submit to the MACC full, unedited video recordings of conversations with Sabah elected representatives that allegedly proved corruption. During this press conference, she emphasised that she would not reveal the whistleblower’s surname for his own protection — demonstrating her understanding of the extremely sensitive nature of the situation. Conversely, only hours later, Azam Baki chose to reveal the whistleblower’s full name to the media at a press conference in Kota Kinabalu, Sabah,” the statement said.

The WPA 2010 itself defines “confidential information” as including information about the identity of a whistleblower — which obviously would cover his full name. C4 Center questioned the decision to release his name directly to members of the media before the provision of statutory protection to the whistleblower.
